A residence permit may be revoked before the card’s expiration date if a foreign national no longer meets the requirements for residence, has provided false information, has left the country for an extended period, or has violated the conditions of their status. Experts at the immigration firm Migranteu have identified the main reasons for the revocation of residence permits and permanent residence status and explained which changes must be reported to immigration authorities in a timely manner.

Lawyers note that revocation of status, denial of renewal, and invalidation of a document are distinct procedures. Their grounds and consequences depend on the legislation of the specific country.

Loss of Basis for Residence

A temporary residence permit is usually tied to a specific purpose: work, study, entrepreneurship, remote work, investment, or family reunification. If this basis ceases to exist, the immigration authority may review the foreign national’s status.

Such situations include termination of an employment contract, expulsion from a university, cessation of a company’s operations, or the closure of an investment project. For a digital nomad, the basis for review may be the loss of remote income or a transition to working for a local employer, if the program does not permit it.

Termination of employment does not always mean immediate revocation of a residence permit. In some countries, there is a grace period to find a new employer or switch to a different basis for residency. However, any changes that occur must be reported within the period specified by law.

Inaccurate Documents and Fictitious Grounds

A residence permit or permanent residence status may be revoked if, after the document has been issued, it is discovered that the applicant provided false information. This includes forged certificates, a fictitious employment contract, an inaccurate bank statement, or an address where the person does not actually reside.

Marriages and partnerships used as the basis for a family-based residence permit are subject to separate verification. If the authorities prove that the relationship was entered into solely for the purpose of obtaining immigration status, the permit may be revoked.

“A positive decision does not end the investigation. If inaccuracies in the documents are discovered later, immigration authorities have the right to reopen the case and review the status that was granted,” explained Migranteu.

Excessively Long Absence

One of the main reasons for losing permanent residence status is prolonged residence outside the country. The permissible periods of absence depend on the type of permanent residence status.

According to EU Directive 2003/109/EC, EU long-term resident status may be lost after 12 consecutive months outside the European Union. Other grounds for loss may include obtaining equivalent status in another EU member state or a six-year absence from the country that granted the status. National legislation may provide for exceptions and longer permissible periods of absence.

Different rules apply to EU citizens and their family members. The right of permanent residence granted under Directive 2004/38/EC may be lost after an absence from the host country of more than two consecutive years.

Failure to Meet Financial Requirements

Certain types of residence permits require ongoing proof of income, savings, or financial independence. If an applicant’s income falls below the established minimum, this may affect the renewal or extension of the permit.

It is especially important for holders of residence permits for digital nomads, financially independent individuals, and entrepreneurs to comply with financial requirements. Immigration authorities may verify not only the balance in the account but also the regularity of income and the legality of its source.

Lack of valid health insurance may also constitute a violation if it is a mandatory requirement of the program.

Working in Violation of Residence Permit Conditions

Not every type of residence permit grants unrestricted access to the labor market. A student residence permit may limit the number of working hours; an entrepreneur’s permit may not grant the right to work as an employee; and “digital nomad” status may prohibit employment with a local company.

A violation may include working for another employer without prior approval, engaging in activities not covered by the permit, or working in the country while holding a residence permit that does not grant the right to work.

Threat to Public Order and Security

A serious crime, a threat to national security, or a current entry ban may serve as grounds for revoking a temporary residence permit or permanent residence permit. When making a decision, the authorities typically take into account the nature of the violation, the length of the foreign national’s stay, their family ties, and the consequences of revoking their status.

What to Do After a Revocation Decision

First and foremost, you must obtain a written decision and determine the specific grounds for revocation of your status. The document typically specifies the deadline for filing an appeal, the procedure for departure, and the option to apply on different grounds.

Filing an appeal does not automatically suspend the enforcement of the decision in all countries. Therefore, it must be separately verified whether the individual retains the right to remain and work in the country while the appeal is being considered.

“In some cases, it makes sense to challenge the decision; in others, it is better to establish a new basis and apply for a different type of residence permit. The strategy depends on the reason for revocation and whether procedural deadlines were met,” noted experts Migranteu.

Lawyers advise against waiting for official notification if there have been changes in employment, marital status, or financial circumstances. Timely contact with the immigration authority often allows one to switch to a different legal basis and maintain uninterrupted residency.
